Prosecutorial Bias + Constitutional Violations

What I have experienced is a testimony to the people of Springfield, OH and Ohio as a whole.
Citizens must do their research on an attorney before you hand over your money. In regards to criminal defense, you surely must do your research of an attorney before you hand your life and money over to that attorney. We have a blind trust when it comes to attorneys. We automatically believe that an attorney will ethically and diligently act on our behalf because we pay them to do so. We believe without any evidence that the title of attorney is synonymous with ethically trustworthy.
Blind Trust.
The attorney I paid to defend me, L. Patrick Mulligan willfully withheld critical evidence from me that would have got my case dismissed. L. Patrick Mulligan and his associate Lindsey Arway had this video in their possession while repeatably telling me there was no way they could win my case. I can see no lawful reason for L. Patrick Mulligan and his associate Lindsey Arway to have not used that video in my defense.
The Lie.
After I learned about the video I filed a grievance with the Ohio Supreme Court Disciplinary Counsel about the obvious attorney misconduct. In the reply to my grievance, the attorney L. Patrick Mulligan and Lindsey Arway admitted to not showing me or revealing that the video existed to me. Their reasoning was that the video was counsel privilege material only. I know that for that video to be classified as counsel only material that video would have had to contain a confidential informant or undercover officer in the video footage.
I’m in the video. It’s a traffic stop video. That reason is a lie.
To further discredit their lie of being counsel privileged only material, my co-defendant and driver of the car saw the video. His attorney showed it to him. This is how I found out about the video after my co-defendant told me. They lied about it being counsel only material and I cannot understand how the Ohio Supreme Court Disciplinary Counsel believed that lie and closed my grievance case. They took the attorney's word to be true without investigating my claims of the facts. They did not attempt to view the video it proves my grievance to be a fact. But that is a clear example of how the judicial check and balances seem to be a fleeting option and not a guarantee. That is an issue in itself to be addressed in another article.
Ineffective Counsel.
The fact of the matter is even if it were true that the dashcam video is counsel privilege material, which totally is not true, L. Patrick Mulligan and Lindsay Arway still had the legal and ethical obligation to present the contents of the dashcam video in my defense.
Instead, they acted as if this video did not exist.
If L. Patrick Mulligan and Lindsay Arway would have ethically and lawfully did their duty as paid defense attorneys, I would not be suffering this unlawful incarceration. I would not have lost my job as a union Journeyman Carpenter. My ten-year-old daughter would not be crying to me over the phone that she misses me and wants me home. If L. Patrick Mulligan and Linsday Arway would have done what their oath as attorneys compels them to do I would have been home to take my son to get his suits for his high school prom and graduation. I would have seen my grandbaby take her first steps. At the time I was maliciously arrested by the Springfield, OH police, my grandbaby wasn’t yet a year old. Now she is walking and talking. It hurts my heart to know when I get home I will be a stranger to her.
Not all attorneys are unethical snakes, however, we must stand up and be proactive in preventing ourselves and loved ones from being victimized by those attorneys who are. Before you trust an attorney with your life and freedom, read reviews from other people that have done business with them and don’t be afraid to ask them about their history. Ask questions about your case and if they are reluctant or seem to be avoiding answering questions about concerns related to your case, then they don’t deserve your money. I would rather sit in jail for however long it takes for me to find real representation than go into the courtroom with an attorney who is not working wholeheartedly on my behalf.
Fight for Freedom.
I have felt the overwhelming responsibility to share my experience with as many people as possible to motivate people to stand up and be proactive when you are being treated unjustly. Standup and be proactive in selecting who you allow to represent YOUR LIFE. Most of all stand up for what is right. Stand up and don’t allow yourself to be victimized by phony attorneys taking your money and not doing what you paid them and have trusted them to do. Stand up and challenge systems and norms that unjustly persecute you. Stand up and be fair and equitable liberties you are entitled to under the provisions of the U.S. Constitution.
