    • FABRICATED TRAFFIC STOP LEADS TO ARREST

       

      Springfield, Ohio Police claimed a turn signal violation was the reason for Dec. 2018 arrest.

      THERE WAS NO TURN SIGNAL VIOLATION.

      Springfield PD orchestrated an unlawful traffic stop, submitted false probable cause affidavits and willfully and knowingly committed perjury.

    • LAWLESSNESS IN OHIO

      On December 8, 2018 Eddie Ash was arrested by Springfield Ohio Detectives in Clark County after an orchestrated traffic stop for a fabricated turn signal violation that Ohio Highway Patrol dashcam video corroborates. Following is Eddie's personal account of the events that transpired on that date and the months following.

      ILLEGAL TRAFFIC STOP

      Springfield, Ohio Police orchestrated an unlawful traffic stop, submitted false probable cause affidavits and willfully and knowingly committed perjury. I was the passenger in the vehicle targeted.

      CONSTITUTIONAL VIOLATIONS

      Springfield, Ohio egregiously violated the Fourth & Fourteenth United States Constitutional Amendments and the Ohio State Constitution.

       

      Collectively the provisions provided within afford protections of freedom from unreasonable intrusions by the government and any law that abridges or deprives of life, liberty, or property, without due process of law; or denial to any person the equal protection of the laws.

       

      Fourth Amendment : The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violates, and no warrants shall issue, but open probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

       

      Fourteenth Amendment Section 1: All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States, and the State wherein they reside. No states shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of the life, liberty or property, without due process of law; nor deny to any person within it’s jurisdiction the equal protection of the laws.

       

      Ohio State Constitution: I.14 Search warrants and general warrants (1851) - The right of the people to be secure in their persons, houses, papers, and possessions, against unreasonable searches and seizures shall not be violated; and no warrant shall issue, but upon probable cause, supported by oath or affirmation, particularly describing the place to be searched and the person and things to be seized.

      PROSECUTORIAL MISCONDUCT

      Prosecutor Lisa M. Hoying aggressively pursued a plea bargain when she was fully aware that the arresting officers dashcam video clearly proved the driver did use a turn signal proving that the probable cause turn signal violation was a lie. Prosecutor Lisa M. Hoying has denied me any access to the traffic stop video to prevent me from using that key evidence for my appeal.

      INEFFECTIVE LEGAL COUNSEL

      The driver and target of narcotics investigation confessed to the arresting officer that I had nothing to do with drugs found. L. Patrick Mulligan, my paid legal counsel, did not diligently defend me and made me believe that I could not win in Clark County. The attorney promoted the Prosecutions deal offer after I repeatedly told him I did not want to plead guilty to something I had nothing to do with. After accepting the plea under duress, I found out that the dashcam from the State Highway Patrol's car showed that a turn signal was used and my lawyer had knowledge of the video and never told me.

      LACK OF CHECKS & BALANCES

      Prosecutor Lisa M. Hoying violated her duty to pursue and enforce the balance of justice by checking the Springfield P.D. unlawful arrest without just probable cause. My defense attorney L. Patrick Mulligan and his associate Lindsay Arway did not check the prosecutor for her unlawful prosecution without just probable cause and did not diligently seek the balance of justice when they knowingly and willfully withheld the findings of the dashcam video from me and the court.       FIGHT FOR FREEDOM

      The fight for my own as well as your true freedom continues. Us citizens must expose and challenge the willful defiance and reckless disregard of our alienable rights. We must stand up to and expose those who use their position of service as a position of power to victimize people under the color of the law. The Justice System is not broken; the individuals that we must intrust to represent justice are broken. Those individuals use the Justice System to carry out their narcissistic prejudice and self righteous views. This fight is personal for me. The Springfield, Ohio Police Department, Prosecutor Lisa M. Hoying, L. Patrick Mulligan and his associate Lindsay Arway and people like them all over this county put forth a physical effort to make injustice a normal thing. We have to put forward a physical effort to destroy that norm.

    • UNLAWFUL BREAKDOWN OF THE CONSTITUTION

      Fabricated traffic stop leads to wrongful arrest

      Investigation Report Submitted By Ohio State Patrol.

      Ohio State Highway Patrol Investigation report states Sgt. Coverstone was called in by Springfield P.D. to assist with a possible traffic stop and advised that the suspect committed an turn signal violation with no turn signal.

      Police Probable Cause Affidavit submitted by Springfield Police.

      Springfield Police Probable Cause Affidavit states Sgt. Coverstone observed the vehicle make a turn signal violation before stopping the vehicle.

      Springfield, Ohio Police pulled over the car I was a passenger in and detained me unlawfully.

      Traffic Stop was orchestrated to circumvent absence of warrant and no probable cause.

      Prosecutors Hoying acknowledges I, Eddie Ash, was neither the target of investigation nor connected to evidence found.

      Prosecutors violated my constitutional rights, Ohio Constitution (article 1 section 14) and Ohio Rules Professional Conduct; Special Rules of a Prosecutor (rule 3.8(a))
